Shias Reiterate MLC Nomination Under Guv Quota
Cite latest HC fiat to State govt for reconsideration of their petition
Hyderabad: In the wake of a Telangana High Court direction to the state government to reconsider their plea, the Shia leaders have reiterated their demand for nomination of a qualified representative for the Legislative Council under Governor’s quota.
Speaking to mediapersons on Sunday, Mohammed Ali Hyder, national general secretary of Shia Civil Council for Social Justice, said despite repeated representations and prior judicial directions from both the Telangana High Court and the Supreme Court, the state had failed to act on recommendations ensuring Shia participation in governance and minority institutions.
He said that in its May 26 order the Supreme Court had given liberty to the petitioners to file a petition under Article 226 and to request the High Court to solve the issue. The High Court order in their writ petition on December 11 reaffirmed the concerns and found that the petitioners made out a clear case of not complying with the earlier directions.
“These representations were repeatedly rejected or ignored without meaningful reasoning. The High Court has now held that such mechanical rejection violates constitutional principles of fairness, equality, transparency and non-arbitrariness,” said Ali Hyder.
Legal counsel V.R. Mannepalli explained that by following previous orders, the High Court categorically passed the orders to the government to consider the name of Mohammed Ali Hyder, a representative of the Shia Council. He said there were 10 to 12 lakh Shias in the state and an educated representative of the community could be the best bet to place their problems in the Council.
