RERA Comes to Rescue of Flat Buyer in Hyderabad
Real estate regulator orders developer to hand over flat with interest in 90 days
Hyderabad: The Telangana State Real Estate Regulatory Authority (TGRERA) has directed Parijatha Homes & Developers to complete the construction work and hand over the physical possession of Flat No. 104 in Block-2 of the ‘Parijatha Pride’ project within 90 days.
The order was issued based on a complaint filed by Kollepara Veera Venkata Satya Vara Prasad. The buyer alleged that despite paying the sale price and getting the property registered in his name in April 2021, the builder failed to deliver the physical possession of the flat as promised by December 2021.
The complainant claimed that the builder had assured, in a letter dated November 22, 2023, that the flat would be delivered by January 31, 2024, and promised compensation with a monthly rent of Rs 7,500 from February 28, 2024 until the flat was handed over. The builder did not fulfil any of these commitments, causing severe financial hardship.
Parijatha Homes argued that possession had been delivered as mentioned in the sale deed and blamed delays on the Covid-19 pandemic, labour shortages and increased material costs. The RERA found that the possession as mentioned in the sale deed was symbolic and that the buyer had not received actual physical possession.
The authority held that the builder is liable for any delay in delivering possession and must compensate the complainant for every month of delay.
In its order, RERA directed the builder to complete all remaining construction work and hand over physical possession of the flat within 90 days of receiving the order.
The order also directs the builder to pay monthly interest at a rate of 11.10 per cent per annum for every month of delay from January 2022 until the flat was delivered. In addition, the builder was required to obtain the occupancy certificate at its own cost.
