HC Orders Status Quo on HYDRAA Action at Zresta Villa

Justice Nagesh Bheemapaka observed that demolitions on disputed land without serving notice and without considering pending litigation were not proper, and directed authorities to maintain status quo on further demolition activity.

Hyderabad:The Telangana High Court has questioned the action of HYDRAA authorities in allegedly demolishing a compound wall at Zresta Villa in Kokapet, Gandipet mandal of Rangareddy district, without prior notice to the affected parties.

Justice Nagesh Bheemapaka observed that demolitions on disputed land without serving notice and without considering pending litigation were not proper, and directed authorities to maintain status quo on further demolition activity. The court was hearing a house motion petition filed by the Zresta Villa Owners Maintenance Mutually Aided Cooperative Society, which challenged the alleged illegal entry and demolition carried out by HYDRAA officials on May 26.

According to the petitioner, the total extent of land in Survey No. 84 of Kokapet is 8 acres and 10 guntas. A portion was reportedly acquired by the government for a proposed pond, while the remaining land was developed by Goldfish Adobe Private Limited in agreement with landowners. Villas were constructed and handed over to buyers in 2019.

The petitioner informed the court that a dispute over 1.09 acres is already pending before a competent court. It also submitted that HYDRAA officials conducted markings on March 31 based on a complaint by one Anil Reddy, but copies of the complaint or related documents were not provided to the society.

Counsel alleged that despite attempts to meet HYDRAA officials and present their case, they were not heard. It was further alleged that officials entered the premises on May 26, attempted to demolish the rear compound wall and erected fencing without prior notice.

After hearing the submissions, the High Court issued notices to HYDRAA, the Chief Secretary of the Municipal Administration Department, GHMC and the police, directing them to file counters with complete details

The matter remains under adjudication.
