KCR, Harish Move HC Seeking Suspension of Justice Ghose Report on Kaleshwaram
BRS MLA Harish urges court to restrain government from acting on findings until final verdict
Hyderabad: Former chief minister K. Chandrashekar Rao and former irrigation minister T. Harish Rao on Saturday requested the Telangana High Court to restrain the government from taking action based on the findings of the Justice P.C. Ghose commission of inquiry into the Kaleshwaram barrages. The report is to be tabled and discussed in the Assembly on Sunday.
They prayed for stopping the government from taking further action based on the report until the court decided on their writ petition filed a few days ago in which they had sought setting aside or quashing of the report.
The High Court last week was not inclined to issue interim orders in their writ petitions, based on the submissions by the state that the government would not take any action until the report was discussed in the Assembly.
According to Chandrashekar Rao and Harish Rao, they were called as witnesses before the Justice Ghose commission but the report faulted them, based on the statements and accusations by third persons. Their contention was that they must be given a reasonable opportunity to cross-examine the persons who made statements against them and that their contentions must be heard by the commission before coming to a conclusion.
The petitioners apprehended that in view of the Assembly session, the government would rush into precipitous action against them based on the findings of the report which, prima facie, was contrary to Section 8-B and Section 8-C of the Commissions of Inquiry Act, 1952.
Chandrashekar Rao had contended that the report’s publication through a presentation and its circulation in the media had tarnished his reputation. The petition urged the High Court to suspend the commission’s report and restrain the state from acting on its findings until the writ petition was finally decided upon.
