GHMC Told Not to Interfere in Banjara Hills Property
Justice Bhaskar Reddy, after perusing the record, directed the authorities not to interfere with the physical possession of the property and posted the matter after summer vacation
Hyderabad: Justice C.V. Bhaskar Reddy of the Telangana High Court on Wednesday refrained the GHMC and revenue officials from interfering with possession of a house property at Road No. 12, MLA Colony, Banjara Hills. The judge was dealing with a writ plea filed by Buddi Prakash Toshniwal and others. The petitioner contended that they are the owners of the 600 sq. yard property but the government, without any basis, is claiming a certain extent of the land. Senior Counsel L. Ravichander alleged that the authorities are illegally interfering with the possession of the house and resorting to high-handed action in dispossessing the petitioners without issuing any notice or conducting any survey. The petitioners contended that even if the government claims ownership to the land it cannot summarily evict the petitioner.
The petitioner pointed to multiple verdicts of the Supreme Court which required that the authorities issue a notice and follow the procedure laid down by law.
Justice Bhaskar Reddy, after perusing the record, directed the authorities not to interfere with the physical possession of the property and posted the matter after summer vacation.
In a later development, the senior counsel again appeared before the court complaining as to how the revenue authorities barged into the land in spite of the orders of the court and defied the court directions. The judge then permitted the petitioner to move an independent application.
