Chennai: Two-wheeler maker to compensate customer for selling old model
He said JK Automobiles, Kolathur had delivered him an old model vehicle. He said the dealer-committed deficiency in service.
Chennai: The District Consumer Disputes Redressal Forum, Chennai (North) directed dealers of a two-wheeler manufacturing firm to pay a compensation of Rs 35000 to a youth for selling him an old model two-wheeler two years ago.
In the complaint, A.Raju of Vyasarpadi submitted that he purchased a two-wheeler - Pulsar - 180-UG 4 ES, from JK Automobiles, Kolathur, a sub-dealer under the main dealer of Shakthi Motors, Purasaiwalkam and M/s.Bajaj Auto Pvt. Ltd., Pune. He paid Rs 88,696 for the bike and for charges for registration and insurance cover on April 7, 2016. The vehicle was registered on June 30, 2016 and the month and year of manufacturer was mentioned as 10/2015.
He said JK Automobiles, Kolathur had delivered him an old model vehicle. He said the dealer-committed deficiency in service. He issued notice to JK Automobiles, Kolathur, Shakthi Motors, Purasaiwalkam and M/s.Bajaj Auto Pvt. Ltd. He sought compensation of Rs 5 lakh for selling him an old model vehicle and for causing him mental agony.
In the reply J.K.Automobiles stated that he booked a blue colour Pulsar bike and paid Rs 18,000 as initial payment on April 5, 2016 and taken delivery from Shakthi Motors show room. After availing several benefits for the October 2015 model, he opted to purchase the vehicle in April 2016. He was treated as a special customer and normal procedure was relaxed and the vehicle delivered at the time of initial payment.
The petition was liable to be dismissed. The bench comprising president K.Lakshmikantham and member D. Babu Varadharajan said JK Automobiles and Shakthi Motors are jointly and severally liable for their negligent act and also to compensate for mental agony and the cost of the complaint. The bench directed them to pay a compensation of Rs 30,000 for causing him mental agony and a cost of Rs 5,000.
