Kerala HC asks ADM to consider Koodal Manikyam fireworks

The court found that till date the application filed by the petitioner for licence for the public display of fireworks was not formally rejected.

Kochi: Kerala High Court on Wednesday asked the Additional District Magistrate, Thrissur, to consider the request of Koodal Manikyam Devaswom,  Irinjalakkuda, for permission to conduct fireworks on Thursday. A division bench, which conducted a special sitting and passed the order, was considering a petition filed by the chairman of Koodal Manikyam Devaswom.

The petitioner sought to quash the minutes of the meeting held under the chairmanship of ADM, Thrissur, on April 15 in which a decision was taken to prohibit the display of fireworks during the annual festival.

The chairman argued that he was not invited to attend the meeting.  The devaswom submitted that it owns  eight acres of land surrounded on all four sides by a compound wall. There are 12 houses inside 200 metres of the temple compound but all  the owners had  given their consent for the  fireworks.

The court found that till date the application filed by the petitioner for licence for the public display of fireworks was not formally rejected. The application was submitted on March 22.

Considering the contentions that the festival will come to an end on Thursday and that the fireworks were   proposed to be held before 10 a.m., the ADM should take an appropriate decision, the court held.
