A division bench comprising Chief Justice Raghavendra Singh Chauhan and Justice Shameem Akhter was dealing with the PIL by advocates Naresh Sunkara and D. Vidya Sagar who said it was illegal to collect the toll fee under the guise of raising additional sources for the development of highways without providing an alternative road Mr Shashi Kiran, counsel for the petitioners, stated that apart from the life tax on the vehicle, governments were compelling motorists to use tolled highways and pay a huge toll fee.

Mr Kiran said that forcing motorists to shell out money at the toll gates was nothing but fleecing the taxpayer.
