Kochi: The High Court on Monday sought to know from Dileep why he insists on getting a copy of the video containing the assault on ex-costar. It pointed out that the eighth defendant in the abduction and rape case himself had inspected the same at the magistrate court earlier.

The observation came during the hearing the petition of the actor facing conspiracy charges for a copy of the video, which is the vital evidence. Earlier, the prosecution put up a strong argument charging that providing the CD will be a threat to the private life of the victim.

“The demand itself is cruel as the accused who conspired the attack is now demanding the video of the victim being subjected to gangrape," he argued. 
"The case is one which can be taken on the basis of the victim alone, considering the seriousness of the offence. Hence the victim’s rights should be given priority rather than that of the accused.”

Meanwhile, Dileep’s counsel argued that the same is vital for proving his innocence. He claimed that the video was edited and the special investigation team was yet to ascertain the female voice in it other than that of the victim.

Providing a copy of the evidence is the right of the accused and the same may prove vital during the trial of the case, he argued. Earlier, the SIT too pleaded the court not to share the sensitive piece of evidence though it has no objection to the actor inspecting the same in the presence of the court.
