TDR scam: Karnataka High Court asks ACB to continue probe
The state government had filed an appeal challenging the single-judge order.
BENGALURU: The Karnataka High Court has quashed the order of a single-judge bench which entrusted the investigation into an alleged scam on the issue of Occupancy Certificate (OC) and well as Transferable Development Rights (TDR) to the SIT headed by IPS officer Abdul Ahad.
Citing that the allegations are serious, a division bench headed by Chief Justice A.S. Oka told the Anti-Corruption Bureau (ACB) to continue the probe.
It is left to the discretion of the ACB chief as to who should be appointed as the investigating officer (IO) to probe the alleged scam, it said.
In July, the single-judge bench issued several directions to the SIT headed by Abdul Ahad, including conducting the investigation into the scam on issuing occupancy certificates to high-rise and low-rise buildings constructed within BBMP limits from January 1, 2018 till July 26, 2019.
The single-judge had directed Abdul Ahad to inquire issuing of TDR by the BBMP from 2007 to 2015 and thereafter by the BDA when they were entrusted with the powers to issue TDRs.
