Supreme Court reserves order on Tamil Nadu, Karnataka plea

The Bench asked Karnataka to release 2,000 cusecs of water to TN till the pronouncement of the verdict.

New Delhi: The Supreme Court on Wednesday reserved its verdict on the preliminary issue relating to maintainability of the appeals filed by Karnataka, Tamil Nadu and Kerala challenging the 2007 final award of the Cauvery Water disputes Tribunal on allocation of water to the contesting states and Union Territory of Puducherry.

A three-judge Bench of Justices  Dipak Misra, Amitav Roy and A.M. Kanwilkar reserved verdict after hearing Attorney General Mukul Rohatgi for the Centre, senior counsel Fali Nariman for Karnataka, Shekahr Naphade for Tamil Nadu, Jaideep Gupta for Kerala and Nambiar for Puducherry.

The Bench asked Karnataka to release 2,000 cusecs of water to TN till the pronouncement of the verdict.  

The AG told the Bench that the apex court cannot touch the final award of the tribunal as it shall have the same force of a decree of the apex court. He contended that the award has to be implemented by the States concerned as there is no further appeal under Article 136 of the Constitution.
