Nalini's premature release plea can't be entertained: TN govt

The plea has been referred to the Constitution Bench of the court, which is yet to be decided.

Chennai: The State government on Wednesday informed the Madras high court that it cannot entertain the plea from S. Nalini, serving life sentence in Vellore prison for her involvement in Rajiv Gandhi assassination case, seeking premature release, as a similar petition is pending before the Supreme Court.

The state home department’s deputy secretary stated this in his counter affidavit filed in response to the petition filed by Nalini, seeking premature release. Nalini’s petition is pending before a division bench headed by Justice Rajiv Shakdher.

“She is a party respondent in a plea pending before the Supreme Court in connection with remission of sentences of all the seven convicts, moved by the central government. The plea has been referred to the Constitution Bench of the court, which is yet to be decided. In view of the same, the high court cannot interfere in the issue”, the counter added.

The department also submitted that the request made by Nalini through the state government’s scheme for premature release of life convicts who had already completed 20 years of actual imprisonment, have been already rejected by the advisory committee on more than two occasions.
