Thiruvananthapuram: Dealer ordered to pay for non-delivery of bike

The Forum observed that this was a case of deficiency in service and ordered the refund of the cost of the bike with 12 percent interest.

The Thrissur District Consumer Disputes Redressal Forum has directed a bike dealer to refund the full advance on a motorbike and pay Rs 10,000 as compensation for non-delivery of the vehicle on time.

Thiruvananthapuram: The Thrissur District Consumer Disputes Redressal Forum has directed a bike dealer to refund the full advance on a motorbike and pay Rs 10,000 as compensation for non-delivery of the vehicle on time. Also, the cheque given by the dealer as a refund bounced causing inconvenience to the customer.

The complaint was filed by Umesh of Kolagatta House, Puthoor, Thrissur against Swaminathan, proprietor of Kings Auto, Moorani, Palakkad. He was a dealer in the Royal Enfield Motorcycle Company and promised swift delivery of the bike. His representative explained features of a specific model and took Rs 1.55 lakh promising delivery in 15 days.

The full amount was paid in three installments from January 2015 but the bike was not delivered until July 2015.  The complainant then demanded the return of the money he paid in advance and was given a cheque. However, the cheque bounced and Umesh approached Thrissur Consumer Disputes Redressal Forum demanding the return of the money with 18 percent interest.

The Forum observed that this was a case of deficiency in service and ordered the refund of the cost of the bike with 12 percent interest from the date of producing the cheque until the date of realisation. Apart from this compensation was also to be paid, it said.
