Chennai: 2 pvt firms told to repair xerox machine or pay Rs 60,000 to owner

The company sold the machine with one-year warranty. It was causing noise and prints were also not clear.

R, Padmanabhan, R. Padmanabhan, proprietor of R.P. Telecom, Chintadaripet, submitted that he purchased a Xerox machine model Toshiba-e-Studio 166 from M/s. Digital Fine Systems, Ashok Nagar, for '60,000 on October 6, 2008. The company sold the machine with one-year warranty. But soon it started making noise and prints were also not clear. Even after repairing it twice by a service team of HCL Infosystem Limited, Greams Road, the defects continued.

Chennai: The District Consumer Disputes Redressal Forum, Chennai (South), has directed two private companies to repair a malfunctioning Xerox machine in a month. And, if failed the forum directed the companies to refund '60,000 to the owner of a Xerox centre.

In the petition, R. Padmanabhan, proprietor of R.P. Telecom, Chinta daripet, submitted that he purchased a Xerox machine model Toshiba-e-Studio 166 from M/s. Digital Fine Systems, Ashok Nagar, for '60,000 on October 6, 2008. The company sold the machine with one-year warranty. It was causing noise and prints were also not clear.

He said even after repair twice by a service team of HCL Infosystem Limited, Greams Road, the defects continued. He sent representation to the M/s. Digital Fine Systems, and the HCL Infosystem Limited seeks to replace the machine with a new one. As there was no reply, he filed the petition seeking direction to M/s. Digital Fine Systems and the HCL Infosystem Limited to pay a compensation for causing him mental agony along with the refund.

Denying the allegations, M/s Digital Fine Systems, represented by its Autho
rised Signatory and the HCL Infosystem Limited, stated that a service staff from HCL Infosystem Limited rectified the machine. Again, Padmanabhan raised the same complaint. This was also rectified on March 26, 2009, and he was also satisfied with the service. There was no manufacturing defect in the machine.

They had not committed deficiency in service and petition liable to be dismissed, they said.

The bench comprising President M. Mony and Member K. Amala has directed M/s. Digital Fine Systems and the HCL Infosystem Limited, to repair the machine in 30 days. 

And failing which they are liable to refund the cost of '60,000 and cost of '5,000, the bench added.
