RJD leader Shahabuddin back in jail as bail cancelled

It said the court granting bail should exercise its discretion in a judicious manner and not as a matter of course.

New Delhi: The Supreme Court on Friday ordered the cancellation of bail granted by Patna High Court to RJD leader Mohd. Shahabuddin and directed the Bihar government to take him to custody forthwith and put him behind bars.

A bench of Justices Pinaki Chandra Ghose and Amitav Roy, while allowing appeals for cancellation of bail said the law in regard to grant or refusal of bail is very well settled.

It said the court granting bail should exercise its discretion in a judicious manner and not as a matter of course. Though at the stage of granting bail a detailed examination of evidence and elaborate documentation of the merit of the case need not be undertaken.
