Supreme Court Refuses To Cancel Ex-IAS Officer’s Bail
The Supreme Court says corruption suspicions must be backed by foolproof evidence, and trial proceedings must remain unaffected.
New Delhi: The Supreme Court on Thursday declined to interfere with the bail granted to retired IAS officer Anil Tuteja in corruption cases but allowed the Chhattisgarh government to approach the High Court for cancellation of bail if he misuses the relief.
A bench comprising Chief Justice Surya Kant, Justice Joymalya Bagchi and Justice V. Mohana was hearing the state government’s appeal challenging the High Court orders granting bail to the former Chhattisgarh-cadre officer.
Tuteja, who held key positions during the previous Bhupesh Baghel government, faces investigations in several corruption cases, including the alleged liquor scam, irregularities in the District Mineral Fund (DMF) and the coal levy scam.
“The state can approach the high court for cancellation if there is any misuse of bail. We agree with you. There is a strong suspicion that they are involved in corruption. But that suspicion has to be converted into foolproof evidence,” the Chief Justice observed.
The bench clarified that observations made by the High Court while granting bail were confined to the bail proceedings and would not influence the trial. “The trial court shall not be influenced by those observations,” it said.
The Supreme Court noted that the bail orders had been passed in December 2025 and January 2026. It said the state could approach the High Court if there were instances of misuse of bail.
The Chhattisgarh Economic Offences Wing and Anti-Corruption Bureau recently filed their 10th supplementary chargesheet in the alleged liquor scam, naming 20 persons, including former state Congress treasurer Ramgopal Agrawal, and 22 firms as accused.
The Supreme Court had granted Tuteja bail on May 18 in a corruption case involving alleged irregularities in the DMF.
Tuteja had been in jail in connection with various corruption cases since January 24, 2024, before securing bail.
