Pay Rs 50,000 to file plea on CRDA validity in Hyderabad High Court

Hyderabad: A division bench comprising Acting Chief Justice Dilip B. Bhosale and Justice S.V. Bhatt of Hyderabad High Court on Thursday directed a petitioner to pay Rs 50,000 to hear her petition seeking to declare Rule 5 (1) to (15) of AP Capital City Land Pooling Scheme (Formulation and Implementation) Rules 2015 as ultra vires of the Article 14, 19 and 21 of the Constitution.

Ms Neerukonda Jhansi-rani, a resident of Guntur moved a petition stating that the said rule discriminates and omits poultry farmers as they are not being treated at par with dry and wet farmers and horticulture farmers in the Land Pooling Scheme Area.

She told the court that authorities have deliberately undervalued the cost of lands in Tulluru, Tadepalli and Mangalagiri to deprive proper market value compensation to land holders, particularly the land and structures/poultry sheds/residential building belonging to her.

The bench pointed out to counsel for the petitioner if she was seeking a specific relief for her or desired to stall the entire developmental activity in the capital region.

When the counsel replied that the petitioner apprehending that her lands will be acquired by the authorities for a meagre price, the bench said in such case there is no point in seeking an order to declare Rule 5 (1) to (15) of AP Capital City Land Pooling Scheme Rules 2015 as ultra vires of the Article 14, 19 and 21 of the Constitution.

The bench directed the petitioner to deposit Rs 50,000 to hear her petition and posted the case after two weeks.

After the order, the counsel for the petitioner requested the court to recall the order with regard to depositing the money as the petitioner is a widow and she is unable to pay the amount as ordered by the court.

The bench told him to make the same submission on the next date of hearing and it will decide on the day.
