Kerala Upa Lok Ayukta order on Circle Inspector stayed

The Upa Lokayukta also asked the investigating officer to produce the copies of the case diary

Kochi: Kerala High Court on Tuesday stayed the Kerala Upa Lokayukta order initiating action against the Peramangalam Circle Inspector for not recording the statement of  security guard Chandra Bose who was murdered by controversial businessman Nisham of Thrissur.

Justice C.T. Ravikumar stayed the order for two months after Peramangalam CI Biju Kumar moved the court seeking to quash the order of the Upa Lokayukta.

The Upa  Lok Ayukta had initiated suo motu proceedings against the petitioner as it was found that the petitioner was  guilty of misconduct, maladministration and that he had abused his position as a public servant to obtain  gain for himself and  favour to the accused.

The Upa Lokayukta also asked the investigating officer to produce the copies of the case diary. Special prosecutor C.P. Udayabhanu submitted that the Upa Lokayukta had no jurisdiction to inquire into or  call for the records of the  investigation of a case which is a subject matter of an investigation under the Criminal Procedure Code.
