No order without hearing MLA: Hyderabad High Court
The bench was dealing with a petition by BJP leader Raghunandan Rao.
Hyderabad: A division bench, comprising Acting Chief Justice Dilip B. Bhosale and Justice S.V. Bhatt, of the Hyderabad High Court on Thursday made it clear that no interim order can be passed without a comprehensive hearing, on a plea seeking disqualification of G. Mahipal Reddy, TRS MLA from Patanchervu constituency in Medak district.
The bench was dealing with a petition by BJP leader Raghunandan Rao, seeking disqualification of the MLA as he was convicted by a trial court in Sanga Reddy and sentenced to two-and-a-half year imprisonment in an extortion case.
Counsel for the petitioner urged the court to grant an interim order directing the authorities to immediately issue notification for vacation of Assembly seat.
When counsel for the MLA informed the bench that the sentence and conviction were suspended by the appellate court, the bench said that the issue needs detailed hearing and adjourned the case to the third week of January.
