Chennai: The general council and executive committee meeting of the AIADMK will be held as scheduled on December 31 at the Sri Ramachandra Medical College and Research Institute (SRMCRI) at Tiruvanmiyur here, as the Madras HC on Wednesday dismissed two public interest litigations, challenging the same.
A Vacation Bench comprising Justices K. Kalyanasundaram and S. Vaidyanathan at a special sitting late on Wednesday evening dismissed the PILs filed by Satta Panchayat Iyakkam (SPI) by its president S. Elango and social activist ‘Traffic’ Ramaswamy, which sought to restrain the AIADMK from conducting its meeting at SRMCRI premises. Concurring with the submission of advocate general A.L. Somayaji, the court said the petitioners claimed they had sent representations to the authorities concerned against the conduct of the meeting.
But, there was no proof to show that the representations have reached the authorities. Even if there was any violation regarding clause 3 of the sale deed dated July15, 2014 relating to assignment of land to SRMCRI, the remedy for the petitioners was not under Article 226 (writ jurisdiction), the Bench added.
Rejecting at the threshold, the contention of the petitioners that the AIADMK had violated the code of conduct, the Bench said, “As of today, there is no notification regarding holding of any election and that the said code of conduct comes into force from the date of the notification fixing the date of election”. The AG said applications had been sent to authorities concerned for erecting hoarding and banners.
