Varsity told to give date for staff split
Hyderabad: A division bench comprising acting Chief Justice Dilip B. Bhosale and Justice S.V. Bhatt of the Hyderabad High Court on Thursday asked the AP government and Dr YSR Horticultural University to inform by Monday the time they require to work out modalities for the division of the varsity staff between AP and TS.
The bench was dealing with petitions by the university, represented by its registrar, and several employees of the Konda Laxman Telangana State Horticultural University, challenging the decision of the Telangana Horticultural University in allotting 33 employees, including 27 assistant professors and six non-teaching staff, to the YSR Horticultural University.
While finding fault with the decision of the Telangana Horticultural University to relieve 33 employees based on their AP nativity, the bench observed that prima facie the decision appeared unilateral. The bench asked why the two governments do not come to an understanding on such issues.
AP advocate-general P. Venugopal said the relieving of 33 employees was in violation of Section 75 of the AP Reorganisation Act and one year had not lapsed following the inclusion of the horticulture university of AP in the 10th Schedule.
TS advocate-general K. Ramakrishna Reddy said that the Horticulture University was an autonomous body and had the power to take a decision on transfer of employees. The decision to relieve the petitioner employees was done in accordance with the bifurcation Act. He said that the AP university has not come forward for discussions though a request was made to it.
The bench questioned how the employees would be relieved suddenly even before completion of one year with regard to inclusion of AP Horticulture University in the 10th Schedule. How would the guidelines be finalised when there was no mention of Telangana Horticulture University in the 10th Schedule, it asked and posted the matter to Monday.
