Supreme Court asks Centre to prepare MoP

Court says common man should have say in top judges’ appointment.

New Delhi: The Supreme Court on Wednesday empowered the Union Government to come out with a more transparent Memorandum of Procedure relating to appointment of judges in the higher judiciary in consultation with the Chief Justice of India to ensure that common man has a say in the appointment.

A five-judge Constitution bench comprising Justices J.S. Khehar, J. Chelameswar, Madan Lokur, Kurian Joseph and A.K. Goel passed this order taking note of the submissions of the Attorney General Mukul Rohatgi that it was always the Centre which prepares the MoP in accordance with the directions of the nine-judge bench decision in 1998.

Disposing of applications relating to suggestions on improving the present collegium system following the striking down of the NJAC law, the Bench said “It is important to note that the compilation of the written suggestions placed before us was in the nature of a summary prepared out of approximately 11,500 pages of views expressed. Even though the task seemed to be daunting, we felt obliged to take up the responsibility, as it was after all, for an improvement of the judicial system and such an opportunity must not be lost.”
