Supreme Court won’t entertain plea on Chennai floods

Supreme Court declined Tuesday to entertain a public interest writ petition to call for the relevant records.

New Delhi: The Supreme Court declined Tuesday to entertain a public interest writ petition to call for the relevant records and master plans of the storm water drain system pertaining to the states of Tamil Nadu, Puducherry and Andhra Pradesh, which were devastated by recent floods.

A Bench of Justices Madan B. Lokur and Uday Lalit asked the petitioner to approach the High Court when senior counsel L. Nageswara Rao, appearing for Tamil Nadu, brought to the notice of the bench that a petition is already pending in the Madras High Court, which is to hear the matter again tomorrow.

Leading Chennai lawyer A. Sirajudeen explains - In the matter of violation of fundamental right to life, the jurisdiction of the Supreme Court is concurrent with the High Court.

Hence, when a PIL has already been taken up by the High Court, the Supreme Court has, rightly directed the parties to approach the High Court.
