Ayukta ouster motion: Kagodu Thimmappa prefers caution

BENGALURU: Speaker Kagodu Thimmappa has decided to tread with caution and consult several legal luminaries and experts on the constitution before forwarding motions for ouster of Lokayukta Justice Bhaskar Rao and Upa Lokayukta Justice Subhash B Adi to the Chief Justice of Karnataka High Court.
A senior official of the legislature secretariat told DC that the Speaker was wary of consequences of acting without the advise of experts in the light of strictures passed by the Supreme Court while restoring the membership of 11 MLAs by then Speaker K G Bopaiah ahead of the vote of confidence in the Legislative Assembly a couple of years ago.
Though their disqualification was upheld by the high court, the apex court struck down and passed strictures against Mr Bopaiah.
Therefore, Mr Thimmappa has decided to consult legal experts including the Advocate General.
Sources said once the Speaker writes to the CJ, Lokayukta and Upa Lokayukta would not be allowed to perform their duties. Therefore, the Speaker has decided to take sometime to act on motions, sources said.
Meanwhile, the Speaker’s office has declined to furnish documents related to Upa Lokayukta to BJP MLA and former minister Suresh Kumar.
Mr. Suresh Kumar had sought copies of the notice of Congress legislators and evidence submitted against the Upa Lokayukta, sources added.
