Madras High Court declines to transfer investigation to CBI

Justice R. Subbiah before whom a petition filed by Vishnupriya’s father, M.Ravi, came up for hearing, said “I have satisfactorily come to the conclusion that investigation is going on in a proper and right direction and there is no infirmity in the CB-CID investigation”.

In the writ petition, Ravi submitted that the CB CID investigation was an eyewash. In order to preserve evidence and to prevent witnesses from being terrorised, he sought transfer of the case to CBI.

The judge said the CB-CID had examined several persons including Namakkal SP, Senthilkumar and K. Maheswari, DSP of Keezhakarai and Aravakurichi DSP Geethanjali, Jerin, DSP of Sankagiri, S. Vijayaragavan and Malaviya advocates and others and also collected various material documents – such as suicide note, medical report, details of telephonic conversation made by Vishnupriya through mobile phones etc.

The judge said, therefore, taking note of the fact that the CB-CID had been conducting investigation in a proper and considered manner he was of the view that there was no need to entrust the investigation to any other agency, especially CBI.

The petitioner’s allegations were without any prima facie material to believe reasonably that officers are influencing the investigation”.

Rejecting the petition, the judge said no grounds were made out by the petitioner for warranting transfer of investigation to CBI.
