Chandrabose murder trial: State ordered to provide protection to Mohammed Nisham
New Delhi: The Supreme Court on Monday directed the Kerala government to grant protection to Mohammed Nisham, during his deposition in the trial court and during cross examination of witnesses in the case relating to attempt to kill a security guard by running over him in his car.
A Bench of Justices Dipak Misra and Prafulla C. Pant gave this direction on a petition filed by Nisham seeking transfer of the trial to a neighbouring State as the atmosphere in Kerala was not conducive for a fair trial.
When Justice Misra said, “We will not transfer the case,” counsel H.P. Sharma, appearing for Nisham said he would be satisfied if sufficient protection was ordered to Nisham as he had to face a mob every time he comes to the court.
When senior counsel Kapil Sibal, appearing for Kerala suggested in camera hearing to keep the mob away, the bench said the accused should be given protection.
Mr Sibal agreed and said protection would be provided to Nisham on the days of cross examination of witnesses and during his Section 313 CrPC. deposition.
The bench directed the state to ensure that Nisham was safely brought to court and taken back without any hindrance.
