Thrissur: During the trial in the Chandrabose murder case on Monday, the trial court judge put some restrictions on the defence from cross-examining the magistrate who had registered the CrPC 164 statements of the witnesses.
In the afternoon, defence lawyer B. Raman Pillai started cross-examining magistrate K.C. Anoop, presently the sub-judge in Thrissur, who had recorded the statements of nearly 12 witnesses in the case, by pointing out certain omissions by comparing the statements they had given to the police and the magistrate.
Special public prosecutor C.P. Udayabhanu intervened and said that the magistrate is a judicial officer and his job was to record whatever the witnesses told him while re-cording the statement in the closed court as per CrPC 164 and that he could not be questioned like other witnesses.
Trial court judge K.P. Sudheer agreed with the prosecution and the cross-examination of Mr Anoop continued accordingly.
He told the trial court that he recorded whatever the witnesses in the case had told him and that remains as a record of the court.
The prosecution lawyers told DC that there would not be trial on Tuesday and Wednesday. The last prosecution witness, Circle Inspector P.C. Bijukumar, who is the investigation officer in the case, will be examined on Thursday.
The defence asked the court for a two-day break to prepare for the cross-examination of the investigating officer, which was agreed upon.
