Karnataka Bar Council to conduct probe against suspended Madurai advocates
As such the probe would not be conducted in a free and fair manner
Chennai: The Bar Council of India has directed the Bar Council of Karnataka to conduct a probe against 14 suspended advocates from Madurai who staged a series of demonstration against judges in six weeks.
In an order dated November 17, sent to the Bar Council of Tamil Nadu and Puducherry, BCI chairman, Manan Kumar Mishra, has transferred the probe, as per the original order, to the Bar Council of Karnataka from Bar Council of Tamil Nadu and Puducherry.
Last week, the Madras high court has directed BCI to take a decision on a plea of writ petitioners M. Mohamed Rafi and others seeking to transfer the proceedings to Karnataka Bar Council.
They alleged that two of the three members of the disciplinary committee of Bar council of Tamil Nadu and Puducherry were having close link with the advocates against whom disciplinary action was initiated.
As such the probe would not be conducted in a free and fair manner. The court directed BCI to take a decision on the issue within a week. The BCI has stated that permitting the proceedings to be conducted by Tamil Nadu Bar Council committee will give room for more grievances and complaints in future. Hence, BCI transferred the matter back to Karnataka Bar Council . It also directed the Karnataka Bar Council to constitute a three-member panel consisting of its own members and conclude the probe in six weeks.
