Counsel directed to assist Madras HC on plea seeking demolition of block

Chennai: The Madras high court has directed counsel appearing for owner of multi-storeyed building which collapsed at Moulivakkam here in June last year killing 61 persons, and others to assist the judge who is hearing a petition seeking demolition of the other block standing near the collapsed one.
In a petition, M. K. Stalin, DMK treasurer, among other things, has sought demolition of Block-A, which is in a precarious condition.
Counsel for the building owner assured that the construction was sturdy. He was categorical there was no danger from the building. The owner assumed full responsibility qua the sturdiness of the building and any consequences which may arise if the position is to the contrary.
Counsel submitted that in a revision petition, owner had challenged the demolition order of the Kancheepuram collector on account of certain technical and other reasons. Advocate General A.L. Somayaji submitted that because of the rainy season there is every possibility of the other block also collapsing. A single judge had stayed a show cause notice to the owner why the existing structure should not be demolished.
The First bench of Chief Justice Sanjay Kishan Kaul and Justice Pushpa Sathyanarayana said “In the given scenario we are of the view that it could be appropriate that counsel for the parties fully gear themselves to assist the single judge on November 23.”
