Plea for action against ‘hostile’ Nisham wife
Thrissur: The prosecution in the Chandrabose Murder case on Monday filed a petition before the trial court here against Amal, the 11th prosecution witness and wife of the accused in the case of Mohammed Nisham, alleging perjury.
Amal had turned turned hostile during her examination in the trial court last week. Special Public Prosecutor C P Udayabhanu told mediapersons that in the petition filed as per CrPC 340, the court had directed that a notice be sent to Amal and later the magistrate court concerned would be looking into the petition.
Mr Udayabhanu said that the contention of the prosecution was that Amal deviated from her earlier statement recorded before the magistrate.
That statement had been recorded before the commencement of the trial. Mr Udayabhanu said that Amal could even get the maximum punishment of seven years for lying before the court.
In her statement before the magistrate recorded as per CrPC 164 in March, she had said that she rung up her friend, a resident of Sobha City in Puzhal, during the wee hours of January 29 after Nisham allegedly rammed his hummer against Chandrabose and inflicted fatal injuries on him.
In the 164 statement, she had clearly said that she asked for help from the residents of Sobha City apartment after she understood that her husband would not be taking the injured victim to the hospital.
The prosecution lawyers told DC that during the closed door examination held last week, Amal told the trial court that Nisham was ready to take the injured victim to the hospital thereby deviating from her 164 statement.
