HC: Why was MLA’s mom allowed to deviate from plans?
Hyderabad: Expressing displeasure at the authorities for their failure to take action in respect of illegal constructions, Justice M.S. Ramachandra Rao of the Hyderabad High Court on Thursday ordered the commissioner of TS Industrial Infrastructure Corporation (TSIIC), IDA, Jeedimetla to appear before the court on November 12 and explain reasons for allowing construction of a commercial complex on land belonging to the mother of the local MLA at Shapurnagar in Qutbullahpur.
The judge was dealing with a petition by K.M. Pratap, a resident of Qutbullahpur area, alleging that a huge commercial complex was constructed in violation of the sanctioned plan by K. Shyamala, mother of MLA K.P. Vivekananda, at Shapurnagar.
B. Srinivasa Rao, counsel for the petitioner, alleged that the construction was made by encroaching on public road and without leaving any setbacks. He said that the authorities concerned have failed to take action though the respondent has deviated from the sanctioned plan.
While ordering the appearance of the official, the judge asked counsel for the government why the concerned authorities were showing negligence in taking action against such illegal constructions.
Illegal mining of sand angers judge:
The Hyderabad High Court has directed the TS government to explain why illegal sand mining and transportation was not being treated as a cognizable and non-bailable offence.
Justice C.V. Nagarjuna Reddy was dealing with a petition by Bandari Papi Reddy and others from Medak district seeking to direct the Sangareddy police and tahsildar to release their lorries seized for allegedly transporting the sand.
The judge observed that the menace of illegal sand mining was threatening the very existence of mankind with rivers drying up and people clamouring for water. The judge felt that “Unless such strong measures are taken, it is next to impossible to control illegal sand mining and transportation, which is causing a serious threat to ecology and environment.”
The judge directed the principal secretaries, revenue and mines and geology departments to file affidavits and explain measures being taken by their respective departments to prevent illegal sand mining and transportation.
Plea on GHMC wards declined:
Justice C.V. Nagarjuna Reddy of the Hyderabad High Court on Thursday declined to entertain petitions challenging the decision of the TS government to reduce the number of wards in the Greater Hyderabad Municipal Corporation limits from 200 to 150.
When the judge was dealing with a batch of petitions against the decision, counsel for the government brought to the notice of the court that the state government has reduced the number of wards through an amendment to the AP Municipal Corporations (Fixation of Strength of Elected Members) Rules, 2005.
The judge pointed out that without challenging the amended rules, the decision in reduction of wards cannot be taken for adjudication. When counsel for the petitioners sought leave to file fresh petitions challenging the amended rules and withdraw the present writ petitions, the judge granted him liberty to do so.
