Fortis Hospital molestation case: It’s a fit case for rape, say women’s panel

The state women’s commission has demanded explanation from the police

BENGALURU: The Karnataka State Commission for Women (KSCW) have issued four notices to Fortis Hospital, Deputy Commissioner of Police, Central Division, Police Inspector, High Grounds Police Station, and to the Home Department seeking explanation on the case of a 54-year-old female patient who was allegedly molested by a male medical attendant at Fortis Hospital on Cunningham Road on October 6.

The state women’s commission has demanded explanation from the police regarding the complaint lodged by victim’s husband who alleged that some persons are learnt to have pressurised victim’s side to alter the contents of the complaint forcibly at the police station.

The commission has also demanded action against the Station House Officer (SHO) at the High Grounds police station who failed to collect and record the correct information from the victim and registered the complaint as a mere molestation case under IPC 354.

The commission in its notice to Fortis Hospital sought clarification as to why the accused was relieved from his job immediately without initiating any action against him by the hospital management for the said offence. “We have urged the Health and Family Welfare Minister to initiate stringent action against the hospital as this is a very serious case where the victim is a patient and the perpetrator is a medical staff and the place of offence is a hospital,” said Manjula Manasa, Chairperson, KSCW to Deccan Chronicle.

Ms. Manjula Manasa visited the victim’s house on Sunday and has taken a written statement about the entire incident from her. ”The victim will record her statement before a magistrate on Tuesday noon and after which the magistrate will decide upon whether the said offence will attract sections of rape or not under IPC and then will pass an order for amendment of the FIR,” said Ms. Manasa adding that “Based on the statements submitted by the victim to the commission, it fits well for a case of rape under section 376(C)
of IPC.
