Bench directs auctioneer to give details of properties owned by tainted firm

Hyderabad: The Hyderabad High Court on Monday directed the three-member committee headed by a retired High Court judge to frame the terms and conditions to auction lands belonging to the Agri Gold Group and place them before the court on Thursday.

A division Bench comprising acting Chief Justice Dilip B. Bhosale and Justice S.V. Bhatt was dealing with a petition by the Telangana Agri Gold Customers and Agents Welfare Association, represented by its president A. Ramesh Babu, seeking a probe either by the CBI or ED into the Agri Gold deposits scam.

Counsel appearing for the company informed the Bench that the company had placed its properties’ list before C1 India Pvt Ltd, which was authorised to conduct the auction of the properties.

The Bench directed the company to place a copy of the property details before the three-member committee and asked CI India Ltd to bear the expenses of opening a separate bank account to deposit the amounts received through the auction and to deduct the same from the sale proceedings.

The Bench said that it would issue further orders on Thursday.

Zafar Pahelwan ordered released
The Hyderabad High Court on Monday set aside a detention order passed by the Hyderabad city police commissioner by detaining Hamza Bin Omer alias Zafar Pahelwan, a notorious history-sheeter under the TS Prevention of Dangerous Activities of Bootleggers, Dacoits, Drug Offenders, Goondas, Immoral Traffic Offenders and Land Grabbers Act, 1986.

A Division Bench comprising Justice Nooty Ramamohana Rao and Justice Anis was allowing a petition by Hameeda Begum, wife of the detenue, seeking to declare the detention of her husband as illegal.

The city police commissioner in May, 2015, passed the detention order relying on six criminal cases which were registered against him under various offences under the provisions of IPC, as such the activities of the detenue fall under and within the meaning of “Goonda” as defined under Section 2 (g) of Act 1 of 1986.

The commissioner informed the court that Zafar Pahelwan had been habitually engaging in unlawful acts since 2007. The detention order was confirmed by the Advisory Board in Aug. 2015.

Counsel for the petitioner contended that the detention was illegal and said that the detenue was sent to jail for political purposes in view of the forthcoming election for the Greater Hyderabad Municipal Corporation.

He alleged that the police have been harassing the detenue as he has left the MIM and joined the MBT.

Setting aside the detention order, the bench ordered the authorities to release the detenue from the Charlapally Central Prison.
