Penalty for Uber driver to be declared on October 23

The court said the detailed judgment would be made available on October 23

NEW DELHI: The fast-track court which convicted Uber driver Shiv Kumar Yadav, for raping a female passenger, charged him with under Sections 366 (abducting with an intent to compel her for marriage), 506 (criminal intimidation) and 323 (causing hurt) of the IPC.

After holding the Yadav guilty, the court of additional sessions judge Kaveri Baweja fixed October 23 as the next date of hearing for pronouncing the quantum of sentence.

“Shiv Kumar Yadav is convicted of all charges (framed against him). To come up for arguments on quantum of sentence on October 23,” additional sessions judge Kaveri Baweja said.

On October 7, the court had reserved its verdict for Tuesday. The court said the detailed judgment would be made available on October 23.

Yadav, who was in the court, was stunned after the judgment. The police then escorted him out of the courtroom and took him back to the jail.

His family members, including his wife and parents, were also present in the court.

They tried to talk to him, but the police did not allow any interaction with Yadav and took away. On this, Yadav’s wife burst into tears and maintained that he was innocent.

She alleged that the family was being harassed as it is from a poor background.

“We are from poor background and those who have resources succeed and God is watching everything,” Yadav’s wife said.

The victim’s father, who was present in the court too, said that he was satisfied with the verdict.

“Now I can say the justice has been done to my daughter. I hope that the accused would be awarded life imprisonment,” he said.

Special public prosecutor Atul Shrivastava, appointed for conducting proceedings in the case, said he would demand maximum punishment for Yadav.

D.K. Mishra, the counsel for Yadav, said he would challenge the verdict in the Delhi high court.

According to the prosecution, the incident took place on the night of December 5 when the 25-year-old victim was heading home.
