Madras High Court rejects cop’s plea against inquiry

Case relates to property issue

Chennai: The Madras high court has dismissed a petition filed by an inspector, who sought to quash an inquiry being conducted against him by Directorate of Vigilance and Anti-Corruption personnel.

The matter relates to S. Vijaylaksmi, 65, who sold her property in Sowcarpet to Vijayraj Jain, Anita Devi, Madanlal Jain for a price of Rs 60 lakh in 2010. After selling the property, on September 16, 2011, Parasmal H.Jain, both on his behalf and on behalf of three others, filed a complaint in Elephant Gate Police Station against Vijaylaksmi and her son Thiyagarajan.

Jain, in the complaint, alleged that Vijaylaksmi collected Rs 1.20 crore for selling the property and hence, he sought her to return the excess amount of Rs 60 lakh. Based on the complaint, inspector, K. Sivamani and SI, Rajendran threatened them and forcefully collected Rs 28 lakh and handed over the amount to Parasmal H. Jain.

Earlier, this court directed the police to file a status report. Based on this, the DVAC, on June 14, 2014, registered FIR and ordered a preliminary inquiry. In the current writ petition, inspector Sivamani sought the court to quash the FIR and enquiry.
