Chennai: The Madras High court observed that private school teachers were not eligible to receive salaries on par with government school teachers. The three member bench headed by Chief Justice Sanjay Kishan Kaul, before which an appeal filed by Correspondent, Arokiamada matriculation higher secondary school, Udumalai, Pollachi, came up for hearing, said that even the state government staff are not paid salary on par with their counterparts in Central government. In such a situation, the state government cannot force the management of a private school to pay salary on par with the staff of the central government, which in the opinion of this court, will indirectly force institution to surrender the fundamental rights guaranteed under Article 30 (1) of the Constitution.
The matter relates to T. Sorubarani, (now deceased) joined service in 1989 in Arokiamada matriculation HSS, Pollachi and subsequently terminated in 2001. In 2004 she filed the writ petition seeking a direction to the management for fixing pay on par with the teachers in government schools.
Single judge in order dated 9/6/2009, directing the management to fix the scale of pay guided by rule 16 (ii) of Code of Regulation for Matriculation schools. Aggrieved over the order, the management filed the present appeal.
The matter was referred to the three member bench in view of two conflicting verdicts by two different benches with regard to fixation of salaries of teachers serving in private schools on par with government school teachers.
