Kerala High Court upholds formation of new municipalities
Inclusion of a rural area into an urban area would be beneficial to the people of the locality
Kochi: The Kerala High Court on Wednesday dismissed the appeals challenging a single bench order upholding the formation of 28 new municipalities.
A division bench comprising Chief Justice Ashok Bhushan and Justice AM Shafique, which upheld the order, observed that elected members of respective panchayats had supported the formation of municipalities.
Inclusion of a rural area into an urban area would be beneficial to the people of the locality. It also found that linking of a panchayat area to the municipal area is not contrary to any provisions under the constitution.
The bench observed that it cannot be disputed that the power is vested in every state to constitute a municipal council for a smaller urban area.
The bench also observed that the single judge had not committed any error in dismissing the petitions challenging the formation of new municipalities.
