No court can take a decision on language: Madras High Court
Constitution has provided that all proceedings in Supreme Court and the high courts will be in English
Chennai: The Madras high court has observed that no court has power to decide on matters relating to court language. While granting bail to 10 advocates and law college students, who were arrested for staging a sit-in protest in the first court on September 14 demanding introduction of Tamil as court language, Justice S. Vaidyanathan clarified that "none is against making Tamil as official language in the high court of Tamil Nadu".
He added that no court was competent to decide the language of the court as whether it should be in English or any other language. While so, staging protest and agitations on the high court campus or in the court halls demanding Tamil to be made as the official language in the high court would not serve any purpose. The lawyers, who belong to the elite group, are well aware of the legal aspects.
The Constitution has provided that all proceedings in Supreme Court and the high courts will be in English. Only Parliament has the power to alter this by law. Therefore, the agitators have to pursue the matter with the Central government. Mere protesting and agitating for the sake of publicity, will give no result.
