Supreme Court refuses bail to Mohammed Nisham
The accused was also injured and the victim died in hospital 18 days after the incident
New Delhi: A person like Mohammed Nisham who allegedly attempted to kill a security guard by running over him in his car is not entitled to be released on bail, the Supreme Court observed on Friday while rejecting his bail plea.
A Bench of Justices Dipak Misra and Prafulla C. Pant told senior counsel Gopal Subramaniaum, appearing for Nisham that these people (like Nisham) have become ego centric, megalomanic and treat others with scant respect.
Pointing out that there is also a pride in poverty, the bench said “the allegations are that you (Nisham) an over the security guard. If a man is alleged to have killed another man, should we grant him liberty by releasing him on bail. Such behavior will not entitle a person to get bail. Nihsam may not be a history-sheeter and the manner in which he committed the offence, does not entitle him for bail. ”
The Bench, while dismissing Nisham’s appeal against the Kerala High Court order rejecting bail, directed the trial court in Thirissur to complete the trial expeditiously and pass orders in the case by January 2016.
Earlier Mr. Subramanium submitted that the petitioner heading an 8000 employees unit would not tamper with witnesses or evidence and that he was prepared to stay outside Kerala if he was granted on bail. He said an altercation took place when the security guard did not lift the barricade.
The accused was also injured and the victim died in hospital 18 days after the incident. Nisham is a psychiatric patient, lost his vision partially in the incident and he deserved to be released on bail.
Senior counsel Kapil Sibal, appearing for Kerala strongly opposed bail stating that Nisham had many more cases against him.
