George’s plea quashed, anti-defection law valid

The decision made by the Speaker can be varied or reviewed by the Speaker at the final stage
Kochi: Kerala High Court on Friday dismissed a petition filed by P.C. George MLA who challenged the Assembly Speaker's order holding that the anti-defection plea against him is valid.
Justice Muhammed Mustaque observed that when the Speaker had made a finding based on available records, this court need not interfere with such a decision, unless such finding attains finality. The court is not the appellate authority to sit upon every decision of the Speaker on different stages of the decision-making process.
“The decision made by the Speaker can be varied or reviewed by the Speaker at the final stage, depending upon the outcome of any inquiry to be made on the complaint by P. C. George,” the court observed. “The petitioner alleges that the originals of some of the documents have not been enclosed with UDF chief whip Thomas Unniyadan’s letter to the Speaker. When a member of the House makes such a serious allegation, this court believes that the Speaker will inquire into it,” the bench observed.
“It is not in the domain of this court to direct the Speaker to inquire into it,” it added.
State’s stand on teachers in polls sought
Kerala HC on Friday sought the state government’s stand on a petition seeking a directive to refrain teachers of aided schools from contesting in the elections to the local bodies, assembly and parliament.
A division bench comprising CJ Ashok Bhush-an and Justice A.M. Shaf-fique issued the directive on a batch of petitions. The court posted the case for detailed hearing later. The petitioners contended that the teachers of aided scho-ols are drawing sala-ry fro-m the state government. If they were allowed to contest in polls, it will sabotage the education system.
