Kamineni Academy of Medical Sciences told to admit student

She was denied seat last year

Hyderabad: The Hyderabad High Court has come to the rescue of a girl who was aspiring for an MBBS seat. The college management had denied seat to her despite having merit.

B. Sumahitha of Ranga Reddy district moved the HC challenging the action of the management of Kamineni Academy of Medical Sciences in not providing admission to her for MBBS last year under ‘C’ category.

She told the court that she had secured 97.66 per cent marks and attended EAMCET-2014 and secured the 4178th rank.

She said that she applied for the seat under the management quota in August 2014.

She appeared for the interview and submitted all documents and a DD for Rs 9 lakh as first year fees and a bank guarantee for Rs 36 lakh.

Sumahitha informed the High Court that the college then placed her at serial number 38 by awarding one mark in the interview out of the 15 marks earmarked for it and she was denied admission though she had secured 586 marks and was the second candidate in the merit list.

When she moved court in 2014, the court gave an interim order directing the college to accept the bank guarantee and consider her case for admission into the course for the academic year 2014-15 based on her ranking in C1 category.

While granting the final order after hearing both the sides, Justice A Ramalingeswara Rao said that the allocation of marks in interview in favour of the petitioner was unjust. The aptitude of the petitioner can be gauged by the marks secured in the qualifying examination, and the petitioner would no less be entitled for less than 10 marks in the interview in normal circumstances.

The judge termed that "this case is one of the rarest of rare cases as held in Asha’s case by the Supreme Court and it is clear from the record that the petitioner was unjustly denied a seat.”

As the admissions for 2014-15 academic year were completed and that the students who were admitted in the said year had completed one year, the High Court decided to accommodate her in the 2015-16 academic year.

Allowing the petition, the judge directed the college to include her name in the C1 category and send the list to the NTR Health University along with other candidates in the category for admission in MBBS during academic year 2015-16, and that the varsity shall consider the name and approve her admission under ‘B’ category now.
