Decision on defectors reserved
The petitioners sought disqualification of the MLAs who defected to the ruling party
Hyderabad: The Hyderabad High Court on Wednesday reserved orders on petitions seeking a direction to the Telangana State Assembly Speaker to expedite hearing of pleas pending before him for disqualification of certain Congress and TD MLAs who joined the TRS.
A division bench comprising acting CJ Dilip B. Bhosale and Justice S. V. Bhatt concluded the hearing on separate petitions filed by TD leader E. Dayakar Rao, Congress leader Sampath Kumar and by YSRC MP Ponguleti Srinivas Reddy.
Mr Dayakar Rao has named Talasani Srinivas Yadav, Teegala Krishna Reddy and Challa Dharma Reddy while the Congress petition deals with Kale Yadaiah, D.S. Redya Naik, G. Vittal Reddy and K. Kanakaiah. The YSRC petition names MLA B. Madanlal.
The petitioners said that they sought disqualification of the MLAs who defected to the ruling party under the 10th Schedule of the Constitution. The Speaker has not initiated any proceedings for months.
During the hearing the bench asked the petitioners’ counsel to cite Supreme Court judgements and provisions of law where the court can interfere in such matters. While citing several judgements of the SC and various HCs, counsel said the courts have directed the Speaker for disposal of pending applications within a specific time period.
