Hyderabad High Court seeks helmet report

Steps taken to implement rule sought

Hyderabad: The Hyderabad High Court on Monday sought a report from the transport commissioner of Telangana on implementation of the circular issued on September 2, 2015, making it compulsory for two-wheeler riders to wear helmets.

A division bench comprising acting Chief Justice Dilip B. Bhosale and Justice S.V. Bhatt was dealing with a petition by Mr Vudateneni Rama Rao of Ranga Reddy district that was moved in 2010, seeking to declare the action of the respondents in not implementing Section 129 of the Motor Vehicles Act and Rules 430 and 486 of the AP Motor Vehicles Rules, 1989 which were enforceable with effect from September 1, 1989, as illegal.

Mr A. Sanjeev Kumar, special counsel for the government submitted that the transport commissioner had filed the counter affidavit as per the orders of the court in this regard.

Maintaining that the problem would not be solved with filing of the affidavit, the Bench asked the counsel to explain the steps that were taken to implement the provisions of the Act.

He replied that the government had issued the circular making it mandatory for all two wheeler riders to wear helmets and had also made purchase of helmets compulsory to register vehicles.

The Bench replied: “Everyone knows that the provision of compulsory purchase of helmet is for the benefit of manufacturers. There will not be any meaning in keeping the helmet in the house after purchasing it. The authorities have to ensure that every rider wears it.”

Notice issued to home secy stayed
Justice Vilas V. Afzulpurkar of the Hyderabad High Court on Monday stayed a notice issued by the Chief Metropolitan Magi-strate’s Court, Vijayawada asking Telangana principal home secretary Rajiv Trivedi to appear before it in the phone tapping case.

The official had challenged the notice issued by the Chief Metropolitan Magistrate’s Court.

GHMC to cancel shop licences
A division Bench comprising Acting Chief Justice Dilip B. Bhosale and Justice S.B. Bhatt of the Hyderabad High Court on Monday directed the Greater Hyderabad Municipal Corporation to cancel licences of shops that had failed to give an undertaking to remove encroachments on roads in Siddiambar Bazar and Mahbubgunj areas of the city.

The Bench was dealing with a petition by Mr Laxminivas Agarwal, a resident of Mahbubgunj. Counsel for GHMC informed the Bench that 127 shop owners of the area had given assurances for removal of encroachments while 33 had not.

The Bench then directed the GHMC to take steps for cancellation of licences of the 33 shops, which were not in favour of removing the illegal encroachments. The matter was posted to September 14.

Inaction by cops challenged
Justice A.V. Sesha Sai of on Monday asked counsel for the TS home department to respond on a plea challenging inaction of the Doma police in Ranga Reddy district on the suspicious death of Raheema Bee after consuming poison at the station premises.

Ms Haseena Begum, daughter of the dece-ased, moved the plea alleging that her mother had consumed poison after being subjected to torture and harassment by a sub inspector of the Doma police over a complaint regarding her missing 19 year-old son Mohammed Muqtar.

She alleged that the police did not even record the dying declaration of her mother. The judge directed counsel for the home department to get instructions as to why no action has been taken against the police personnel and file a report within two weeks.
