HMDA ordered to stop all illegal constructions

Counsel replied that the Act barred constructions in unauthorised layouts

Hyderabad: The Hyderabad High Court on Monday directed the Hyde-rabad Metropolitan Development Autho-rity to stop all construction currently being carried out in unauthorised layouts in its limits.

A division bench comprising acting Chief Justice Dilip B. Bhosale and Justice S.V. Bhatt was dealing with a PIL by Ms Rajamani and Mr G. Venkat Reddy, residents of Nadergul,
challenging the action of the HMDA in allowing various real estate companies to carry out constructions in unauthorised layouts in and around Nadergul.

The petitioners brought to the notice of the court that real estate firms were developing the layouts without HMDA appr-oval and the authorities were even allowing construction in such layouts, which was against statutory provisions stipulated under the HMDA Act, 2008.

Reacting to the submissions, the Bench asked counsel for the HMDA about the statutory provisions regarding the layouts developed without approval from the HMDA.

Counsel replied that the Act barred constructions in unauthorised layouts. Asking how the authorities were then allowing the constructions, the Bench directed the HMDA to take steps to stop all constructions not only in Nadergul but also in layouts falling in its purview.

While ordering the HMDA to stop constructions, the Bench issued notices to the real estate firms named by the petitioners including the HMDA and the state government, directing them to file their counter affidavits by September 21.
