New Delhi: A New Delhi court has asked CBI to file a report on the status of proceedings before Chief Vigilance Officer of CPWD and PWD on a plea against former Delhi Chief Minister Sheila Dikshit and others for alleged corruption during 2010 Commonwealth Games.
Additional Chief Metropolitan Magistrate Sudhanshu Kaushik said a report be summoned from the Chief Vigilance Officer (CVO) about the status of inquiry being conducted by it and the action taken against the erring officials.
"It has been mentioned (by CBI in its report) that the matter has already been reported to the Chief Vigilance Officer of CPWD and PWD, Nirman Bhawan, which is looking into the matter. CBI is directed to furnish report about the present status of proceedings before CVO. Report be also summoned from CVO about the status of inquiry and the action taken against the erring officials. Put up on October 9," the court said.
The court passed the directions on a complaint filed by RTI activist Vivek Garg seeking registration of FIR against Dikshit, then PWD Minister Raj Kumar Chauhan and former CWG OC
Chairman Suresh Kalmadi for alleged corruption in CWG-related projects. Delhi Police earlier transferred the complaint to the CBI.
In his complaint, Garg had claimed that "Dikshit, Chauhan, Kalmadi and other top politicians, (then) officials of the Delhi government and the Centre and their nexus of corrupt businessmen connived with each other to cause wrongful loss to the public exchequer and wrongful gain to themselves or persons whom they were interested in."
The court, in its order said that status reports were called from the CBI as well as Economic Offence Wing repeatedly.
"In the last report submitted on April 7, it has been mentioned that in respect of one of the stadiums, inadmissible payment of Rs 3.03 crores and Rs 3.51 crores was found to be made against purchases," the court noted.
The complainant had claimed that Dikshit and others were "guilty of offences under sections 409 (criminal breach oftrust), 420 (cheating), 464 (making a false document), 471 (using a forged document), 477-A (falsification of accounts), 511, 201 (causing disappearance of evidence), 120-B (criminal conspiracy) of IPC and be summoned, tried and punished accordingly."
He had said a total expenditure of Rs 1,000 crore was sanctioned for various works in Jawaharlal Lal Nehru Stadium Complex, Indira Gandhi Stadium, Dr Shyama Prasad Mukherjee Swimming Complex, Major Dhyanchand national stadium, Dr Karni Singh Shooting Range as well as consultancy for various works. But "the corrupt politicians, officials and businessmen/ companies connived with the intention to illegally enrich themselves and spent Rs 2460 crores for which they were not even legally allowed," Garg had alleged.
The complainant had relied on the report of Central Vigilance Commission and that of the Shunglu Committee set up by then Prime Minister Manmohan Singh to probe the alleged irregularities in various CWG projects. Garg had said he had earlier lodged the complaint with the Deputy Commissioner of Police, Economic Offences Wing in November 2011, but since the concerned authorities had failed to act on these complaints, he was constrained to file a criminal complaint.
