Proceedings against DMDK MLA K Dinakaran stayed
Justice B. Rajendran granted the interim stay on a revision petition filed by Dinakaran
Chennai: The Madras HC has stayed for four weeks all further proceedings pending before a magistrate court in George Town against DMDK MLA K. Dinakaran. The case related to alleged assault on a police officer, who attempted to evict him and other DMDK MLAs, who sat within the Assembly precincts to show their protest, after they were evicted by the Marshall from the House.
Justice B. Rajendran granted the interim stay on a revision petition filed by Dinakaran, which sought to set aside an order of the VII Metropolitan Magistrate, George Town, dismissing his petition to discharge him from the case.
According to the petitioner, the alleged facts of the case was that on February 19 this year, during discussion on Governor’s speech in the Assembly, there were heated arguments between the ruling and opposition parties and the Speaker directed the Marshall to evict some of the opposition members and they were duly evicted. The petitioner and other evicted members sat within the precincts of the Assembly to show their protest and raised slogans. On further orders from the Speaker, the defacto complainant (a police officer) and other police personnel tried to evict them and at that time the petitioner and another prevented the police from discharging their duty and attacked the complainant thereby inflicting injuries on him. Based on a complaint from him, a case was registered.
After completion of investigation, the charge sheet was filed. He being falsely implicated in the case had preferred a petition for discharge and the magistrate dismissed the same. Hence, the present petition.
