Madras High Court directs building owner to be present in court
Petitioners said the building belonging to Devaraji, which was put up behind their plot was sealed and locked by officials
Chennai: A building owner, who under the guise of demolishing the deviated portion of his building at Neelankarai here obtained an order from the court to unlock and unseal the building and allegedly put up further construction instead of demolishing the portion, has been directed by the Madras high court to be personally present on September 14.
A Division bench comprising Chief Justice Sanjay Kishan Kaul and Justice T. S. Sivagnanam also directed the then Executive Engineer (Enforcement), who was holding the post at the relevant time when the construction was done, to remain present in the court on the next hearing date.
Passing orders on a contempt petition filed by R. Vadivelu and D. Gopalakrishnan, the Bench also directed the Chennai corporation commissioner to file an affidavit with two weeks after scrutinising the records.
“We have not yet issued notice of contempt to the Chennai corporation commissioner, but we call upon the commissioner to look into the matter and file an affidavit on the basis of the scrutiny of the records within two weeks”, the bench added.
The petitioners said the building belonging to Devaraji, which was put up behind their plot was sealed and locked by officials. Devaraji approached the Madras HC to direct the authorities to unlock and unseal his premises to enable him to demolish the deviated portion.
