Lorry cleaner gets Rs 12.60 lakh compensation

The accident occurred due to rash and negligent driving

Chennai: The Motor Accident Claims Tribunal has directed an insurance firm to pay Rs 12.60 lakh to a lorry assistant (cleaner) for the loss his leg in an accident caused by the driver. His leg was amputated in the accident that occurred in Andhra Pradesh four years ago.
In the petition, K. Rajendran, 50, of Odakathur, Vellore district was working as a cleaner in a lorry. On July 17, 2011, at 11 pm, he was travelling in the lorry.
The lorry driver was driving the vehicle in a rash and negligent manner. As a result it rammed into a lorry going ahead at Jamallpalli near
Kadapa. He sustained grievous injuries and his left leg was amputated in a hospital in Kadapa.
He said the accident occurred due to the act of driver. Hence, D. Jaishankar of Vellore, lorry owner and Royal Sundaram Allianz insurance co ltd,
Royapettah, the insurer of the vehicle, were liable to pay a compensation of Rs 25 lakh. Jaishankar remained absent during trial. In its reply, the insurance firm submitted that Rajendran was also responsible for mishap and hence, he was guilty of contributory negligence.
The petition was liable to be dismissed since the vehicle owner remained ex-parte. Judge of special sub-court J. Chandran said the petitioner was working as a cleaner and there would not be any contributory negligence on his part.
The accident occurred due to rash and negligent driving. The tribunal held that the owner and insurance firm were liable to pay compensation.
