GHMC chief asked to justify plea to stay in Telangana

Hyderabad: The Central Administrative Tribunal (CAT) on Tuesday asked GHMC commissioner Somesh Kumar to explain how he would justify his challenge to his allotment to Andhra Pradesh in view of the fact that the cadre allotment had been completed and the Centre had rejected his contentions.
While dealing with Mr Kumar’s application challenging his allotment to AP, a two-member bench comprising B. Venkat-eswara Rao (judicial) and Ms Ranjana Chowdary (administration) asked him to justify his plea to retain him in TS cadre.
The Centre had made it clear before the tribunal through an affidavit that the All India Service was created under Article 312 of the Constitution in national interest and a member of the AIS has liability to serve either at the Centre or the state to which he or she is allotted.
The Centre said the official cannot have any grievance merely because the cadre to which he was allocated does not suit him and was not preferred by him.
The Centre said that the case of Mr Kumar was rejected as he could not fulfil any of the conditions prescribed for allotment of cadre including swapping as there was no officer available in the same grade pay for swapping.
Mr D.V. Seetharama Murthy, senior counsel appearing for Mr Kumar, said the authorities should have taken into consideration the services rendered by the IAS officers in the undivided state before allocating them arbitrarily.
He pointed out that the inclusion of Mr P.K. Mohanty in the advisory committee was wrong because he had a vested interest in the form of his daughter and son-in-law, both of whom are IAS officers who were awaiting allocation. He faulted the guidelines and termed them discriminatory. The bench posted the case to Friday for further hearing.
