Power staff: Officer to aid Hyderabad High Court

Employees complain against staff division
Hyderabad: The Hyderabad High Court on Tuesday asked the Centre to depute an officer concerned to assist the court decide the dispute with regard to distribution of employees of power distribution companies between the states of AP and Telangana. A division bench comprising Justice R. Subhash Reddy and Justice A. Shankar Narayana was dealing with a batch of petitions by employees of Telangana Power Generation Corporation and Telangana State Southern Power Distribution Company Ltd. challenging their allotment to Andhra Pradesh and vacate stay petitions by the Telangana government and the TSSPDCL.
The employees told the court that they are working in TSGenco and TSSPDCL after bifurcation of AP and they were repatriated to the APTransco and APGenco based on the guidelines framed by the TSSPDCL. The employees submitted that as per Section 82 of the AP Reorganisation Act the TSSPDCL is a competent body to formulate modalities within one year from the appointed day and after elapsing of one year from the appointed date the president is the only competent authority to issue the guidelines. But the TSSDPCL has framed the guidelines after elapsing of one year and repatriated them to the AP which is illegal.
They said that a single judge has stayed the guidelines and directed the TSSDPCL and the T Genco to pay salaries to them, despite the order they have not paid salaries till date and more than 1,200 employees are now on the cross roads as the AP government was also not willing to absorb them on the ground of not having vacancies. The TSSDPCL has contended that it has power to frame the guidelines and it has already moved to vacate stay petitions.
After hearing the arguments, the bench pointed out that the central government ought to have been more proactive and should not have let this present situation arise. The bench felt that there must be permanent mechanism and solution to deal with such situations and asked the assistant solicitor general to ensure that a responsible officer be present before the court on Aug. 25 to assist the court to resolve the issue permanently. While adjourning the hearing to Aug. 25, the bench directed the Centre and the Telangana governments to file their counter affidavits.
